GENERAL PURCHASE CONDITIONS

These General Conditions of Contract (hereinafter, General Conditions) regulate the process of buying and selling the products offered by FRANJA ROJA, SL in the catalog available on its website www.vinosferrer.com


The General Conditions bind FRANJA ROJA, SL and the buyer (Client), granting them a series of rights and obligations, from the moment the latter places and accepts an order through this page. They are mandatory and knowledgeable by both parties, so their acceptance is essential to be able to formalize an order. Therefore, the Client must carefully read these conditions.

The headings of the different clauses are for information only, and will not affect, qualify or expand the interpretation of the General Conditions.


These General Conditions will be regulated by the provisions of current legal regulations.

The sale of alcoholic beverages to those under 18 years of age is prohibited, therefore, FRANJA ROJA, SL will not register or supply anyone under the permitted legal age.

The Client expressly accepts for all communications related to registering on the Web and/or in the acquisition of products, the use of email as a valid procedure for sending said communications.


CLIENT

Any User of the website www.vinosferrer.com who places an order and gives their acceptance to it at the time of placing it will be considered a Client.

The Client must register as such and provide the following data in order to place the order: name and surnames or company name, CIF/NIF/DNI, invoice address, shipping address, contact telephone number and contact email.

These data will be treated in accordance with the provisions of these General Conditions and the Privacy Policy of this site.

The username and password used to register on the Web are identifying data and therefore are personal and non-transferable. FRANJA ROJA SL reserves the right to block or cancel the username and password of those Users who maintain debit or unpaid balances with us, as well as in the event that they detect fraudulent acts or bad faith in the use of the service.


OBJECT OF CONTRACT

The purpose of this contract is the sale of alcoholic beverages belonging to the FRANJA ROJA SL wineries on this website.


OFFER PROCESS

Each product has a file where the description of the product and its sale price with VAT appear.

The final purchase price of a product or its shipping costs may vary depending on the region of destination or the method of payment, since depending on the geographical area where it is sent, costs may vary and depending on the form payment, you can access a series of discounts or not. In any case, as the customer indicates the delivery address and the payment method, the page will offer the exact price of the products.

In most cases, the file of a product will have a photograph of the product, as well as its technical characteristics, which have been obtained from the manufacturer itself or, failing that, from other publicly accessible sources.

On the other hand, sales made by natural or legal persons domiciled in any of the community countries will be subject to VAT.

FRANJA ROJA SL informs that its website is directed exclusively for sales in the Peninsula and the Balearic Islands. For sales outside this territory, please contact the Selling Company.


ACCEPTANCE OF THE OFFER

It occurs at the moment in which the Client gives his express consent to the order placed, and after the acceptance of the General Conditions. It materializes when you accept these and click on the "CONFIRM ORDER" button on the order completion screen.

At the time of activating the order, the client formalizes a product purchase contract with FRANJA ROJA, SL, acquiring the rights and commitments established in the applicable regulations and those set forth in these general contracting conditions.

After accepting the order, FRANJA ROJA, SL will contact the customer within a maximum period of 48 hours to confirm the order.

The invoice issued for the purchase will be sent with the purchased products.


PAYMENT OF ORDERS

The fact that the order is placed does not mean that the product(s) is/are reserved; the product(s) will be reserved at the time the payment is made.

In the event that that product is not in stock at that time, we will contact you to notify you of the situation and inform you of the next availability of the product or, where appropriate, to proceed with the cancellation of the order and its corresponding cancellation. refund of the amount.

1. Payment by credit card:

The customer can choose to pay by credit card, performing the operation at the time of placing the order. Only visa/master card/maestro/euro 6000/american express cards are accepted.

The system will automatically calculate the shipping costs associated with the payment method chosen by the Client, and these total prices will be communicated before the acceptance of the order by the Client.

You must notify BODEGAS JOSÉ L. FERRER. any undue or fraudulent charge on the card used for the purchase, by email or telephone, in the shortest time possible, so that BODEGAS JOSÉ L. FERRER can carry out the appropriate procedures.

2. Payment by bank transfer:

By selecting this form of payment, the customer, once the order has been formalized on the website, can pay the amount of the products by bank transfer.

The Client must make a bank transfer to the account of FRANJA ROJA SL for the amount of the price of the products of the order plus the shipping costs (the total amount will appear on your screen before confirming your order, when you check the general data of the order) .

In the transfer you must indicate the full name of the person or entity to which the order will be invoiced and the number of said order (the number is automatically assigned by the system at the end of the order); in addition to pointing out as beneficiary of the same FRANJA ROJA, SL

The transfer must be made within a maximum period of three working days from placing the order to the bank account that appears on the order confirmation. If within this period there is no proof of payment, the order will be canceled automatically.


DELIVERY TIMES FOR ORDERS

The delivery times of the orders depend on the availability of the product or products that compose them. The delivery time is 48-72 hours for the Balearic Islands, 3-4 days for the peninsula and 7 business days for any territory of the European Union, once payment has been confirmed. These terms may be modified during holiday periods or due to circumstances beyond FRANJA ROJA SL.

For deliveries in territories outside the European Union, you must consult Customer Service before purchasing.

In no case will shipments be made to post office boxes.

However, the delay in delivery will not imply any compensation and will only empower the Client to cancel the order when the circumstances described in the following point of these conditions occur. Any penalty clause for delay entered by the Client in his order is without effect.

FRANJA ROJA, SL will seek in each formalized order the maximum possible information on the availability of the products.

Deliveries will be made through a courier company to the delivery address indicated in the order delivery data. The subsequent modification of this address may generate a series of expenses that will be borne by the Client and the delivery may be affected.


WITHDRAWAL / CANCELLATIONS

The Client is recognized the right to cancel the order within a period of fourteen working days from receipt of the order, as set forth in Article 44 of Law 7/1996, of January 15, on the Regulation of Retail Trade.

To do this, you must notify FRANJA ROJA, SL, completing the withdrawal or revocation document that accompanies the delivery note, so that there is a record of the withdrawal and sending it by post to the FRANJA ROJA, SL Customer Service at the address C/Conquistador 103 07350 Binissalem (Balearic Islands) Spain.

Once the notification of withdrawal has been made, FRANJA ROJA, SL will respond to the request indicating how to return the product. This return will be made within 7 days from the communication to FRANJA ROJA, SL of the return procedure. The costs incurred will be borne by the Client. Along with the product, the withdrawal form and a copy of the delivery note or invoice will be sent.

When the Client has exercised the right of withdrawal or resolution, FRANJA ROJA, SL will be obliged to return the sums paid by the Client. The return of these sums will be made as soon as possible and, in any case, within the legally stipulated period.

If at the time of delivery it is clearly and visibly seen, without the need to manipulate the shipping packaging or the product itself, that a product has defects caused by transport damage or it is seen, in the same way, a error in the product received, you must fill out the withdrawal form that accompanies the delivery note and send it by post to FRANJA ROJA, SL at the address indicated above. In that case, FRANJA ROJA, SL will deliver to the user another product equal to the one purchased, collecting the defective one when delivering the new product, assuming FRANJA ROJA, SL the costs of this management. In the event that the Client has chosen the return of the money, he must indicate in the withdrawal form the owner and the account number in which he wants the corresponding amount to be deposited. The refund of the amount will be made within the legally established time.

The right of withdrawal may not be exercised in the event that the product is not returned in its original packaging and when the product is not in perfect condition. Nor will those rights of withdrawal be addressed outside the stipulated period.


PRODUCT WARRANTY

The legal framework of guarantee (Law 23/2003, of July 10, on guarantees in the sale of consumer goods) aims to provide the Client with different options to demand reorganization when the good acquired is not in accordance with the contract, giving him the option of demanding the repair or replacement of the property, unless this is impossible or disproportionate.

By virtue of this, FRANJA ROJA, SL will respond to the Client for any lack of conformity that exists at the time of delivery of the products ordered, understanding these as tangible assets intended for private consumption.

The delivery note stamped by FRANJA ROJA, SL is valid as a guarantee and must be delivered together with the original of the return sheet that accompanies it in case of claims due to possible incidents (damaged product, wrong product or other cause subject to claim).

For all aspects of the commercial guarantee referred to in Article 11 of Law 23/2003, of July 10, on guarantees in the Sale of Consumer Goods, the content of Law 7/1996, of January 15, Regulation of Retail Trade.


CLAIMS

In accordance with art. 1 of RD 5/1997 January 14, there are claim forms available to our Clients at the company's offices.

CUSTOMER OBLIGATIONS

    Read these General Conditions prior to accepting the order. Respect the General Conditions once the order is accepted. Respect the Privacy Policy accepted after registering on the Web. Pay the prices agreed at the time of placing the order.


OBLIGATIONS OF FRANJA ROJA, SL

    In the event that it is possible to deliver the ordered goods under the conditions agreed with the customer, deliver the product in good condition to the fixed delivery location. Respect the price of the orders agreed upon at the time of placing them.


CUSTOMER RIGHTS

    In case of receiving the products, that they are received in the agreed conditions and that they are in perfect condition. The immediate return of any advance amount to the company in case the company cannot serve the products in the agreed conditions. Cancel the order in the cases established in these General Conditions.

NOTIFICATIONS

VALIDITY OF THE CLAUSES

Even if the invalidity or inapplicability of a clause of this contract or one of its parts is ruled, the rest of the clauses or its parts will continue to be valid and have value.


APPLICABLE REGULATIONS

These General Conditions are governed by current Spanish regulations, and specifically by: Civil Code, Law 26/84 of June 19 General for the Defense of Consumers and Users, Law 7/98 of April 13 of General Conditions of the Contracting, Law 7/96 of January 15, on the Regulation of Retail Trade, Directive 2000/31 CE of the European Parliament and of the Council of June 8, Law 34/2002 of July 11 on Services of the Information Society and Electronic Commerce, Law 23/2003 of July 10 on Guarantees in the Sale of Consumer Goods and the regulations that develop them.


LAW AND APPLICABLE JURISDICTION

The legislation applicable to these Conditions will be Spanish. Likewise, unless the Law expressly prohibits it, for the resolution of all contentious issues arising from these General Conditions regarding the purchase of products or the Privacy Policy, the parties, by mutual agreement, submit to the jurisdiction of the Judges and Courts of Vitoria, expressly waiving any other jurisdiction that may correspond to them.
